Detailed Overview

Maintain Your Brand Monopoly Indefinitely

A registered trademark is one of the very few intellectual property assets that can legally last forever—provided it is renewed on time. Under the Trade Marks Act, 1999, a trademark registration is valid for exactly 10 years from the date of filing the application (not the date of grant). To retain your exclusive legal rights, you must file a Trademark Renewal application before the 10-year term expires. If you fail to renew the mark, the Trademark Registry will officially remove your brand name from the Register, instantly stripping you of your legal monopoly and allowing competitors to hijack your brand identity.

The renewal process can be initiated as early as 1 year before the expiry date. If you miss the deadline, the registry allows a grace period of 6 months, but it comes with significant late penalty fees. If you cross the 6-month grace period, the mark is marked for removal, and restoring it requires a complex Restoration process (Form TM-R). Our IP management team tracks your renewal deadlines and ensures seamless filing of Form TM-R to keep your brand's protective shield intact for the next decade.

At GST Times, we take the legal complexity out of the picture. Our system reviews your files, coordinates with government registrars, handles all clarifications, and delivers your certificate securely to your dashboard online.

Core Benefits & Advantages

Registering for this compliance/setup unlocks critical legal and commercial opportunities for your brand:

Continuous Brand Protection

Renewal ensures your brand remains legally protected against infringement, counterfeiting, and passing off for another 10 years without any break in ownership.

Avoid Expensive Restoration Fees

Filing the renewal before the expiry date saves you from paying massive government late fees and the complex legal procedures required for trademark restoration.

Prevent Brand Hijacking

If your mark is removed from the register, competitors can legally apply for the same name. Renewal ensures your brand name remains off-limits to rivals.

Maintain Valuation Assets

A registered trademark with a long history of continuous renewals commands a significantly higher valuation during corporate M&A deals or franchising negotiations.

Required Documents Checklist

You only need to upload scan copies or photographs of these basic documents. No physical paperwork is required:

Basic Registration Details

  • Copy of the Original Trademark Registration Certificate.
  • The specific Trademark Application Number to be renewed.

Our Step-by-Step Filing Process

We complete your work in four simple milestones, keeping you informed at every turn:

1

Registry Status Check

We check the exact filing date and current status of your trademark on the IP India portal to determine the precise renewal window and applicable government fees.

2

Drafting Form TM-R

We prepare the renewal application (Form TM-R), ensuring that there are no discrepancies in the proprietor's name or address compared to the original registration.

3

Payment of Statutory Fees

We securely process the government renewal challan (₹9,000 per class for companies, or ₹4,500 for MSMEs/Individuals) on the e-TM portal.

4

Issuance of Renewal Certificate

Upon processing, the Registry updates the validity date for another 10 years and issues the official Trademark Renewal Certificate.

Frequently Asked Questions (FAQs)

Got doubts? Here are direct answers from our expert Chartered Accountants:

Can I change my company address or logo during the renewal process?

No. Form TM-R is strictly for renewing the mark exactly as it was registered. If you want to change the registered address, you must file a separate Form TM-P. You cannot change the logo; a new application is required.

What if my trademark expired 4 months ago?

You are within the 6-month grace period. You can still renew the trademark by filing Form TM-R, but you will have to pay an additional government surcharge/penalty on top of the standard renewal fee.

What is Trademark Restoration?

If you fail to renew within the 6-month grace period, the mark is removed. However, within 1 year of expiry, you can file for Restoration (Form TM-R with higher fees) to request the registrar to put the mark back on the register.
